Who takes over Chief Justice position after Gertrude’s suspension?

Following the suspension of Chief Justice Gertrude Araba Esaaba Sackey Torkornoo, questions have emerged about who steps in to assume her responsibilities at the helm of Ghana’s judiciary.
As per the established hierarchy and tradition of the Supreme Court, the most senior justice on the bench typically assumes the role of Acting Chief Justice in the absence of the substantive holder of the office.
That responsibility now falls to Justice Paul Baffoe-Bonnie, the most senior member of the Supreme Court.
Appointed on June 11, 2008 by former President John Agyekum Kufuor, Justice Baffoe-Bonnie has served on the bench for over 15 years and is widely respected for his depth of legal experience and judicious temperament.
A former Justice of the High Court and the Court of Appeal, Justice Baffoe-Bonnie gained national recognition for his role in the landmark 2013 presidential election petition case.
His extensive service and familiarity with both the law and the administrative structure of the judiciary position him as the natural fit to steer the affairs of the Supreme Court during this interim period.
Chief Justice Gertrude Torkornoo, who assumed office in June 2023, was the third woman to occupy the position of Chief Justice in Ghana’s history.
Her suspension has stirred debate and legal commentary, but the transition of leadership, at least temporarily, appears to be proceeding in line with judicial protocol.
While the Judicial Council and other relevant state authorities await the outcome of proceedings related to the Chief Justice’s status, Justice Baffoe-Bonnie will hold the reins, ensuring that the country’s judicial functions continue without disruption.
The Supreme Court, made up of 13 justices, remains the final arbiter of constitutional and legal questions in Ghana. Continuity in leadership is vital for upholding public confidence in the judiciary, especially during times of transition.
As the situation unfolds, the legal community and the general public will be closely watching for further developments on the future of Justice Torkornoo and the appointment of a potential permanent successor—should the need arise.
