Supreme Court clears acting CJ Baffoe-Bonnie to oversee CJ Torkornoo removal case

The Supreme Court has overruled an objection raised by Lawyer Godfred Yeboah Dame, allowing Acting Chief Justice Paul Baffoe-Bonnie to preside over the injunction application challenging the removal process of Chief Justice Gertrude Torkornoo.

Dame argued that the Acting CJ should not oversee the case, claiming he stands to benefit personally from the court’s ruling.

However, Deputy Attorney General Dr. Justice Srem Sai countered that the objection was based on a misconception.

He explained that Justice Baffoe-Bonnie is acting in accordance with the 1992 Constitution, not by personal choice, as he is the most senior Supreme Court judge.

Sai further emphasized that there is no constitutional limitation on the cases the Acting CJ can preside over.

After hearing arguments from both sides, the Supreme Court judges rose to deliberate on their ruling. Upon their return, they dismissed Dame’s objection, affirming that Justice Baffoe-Bonnie is constitutionally empowered to oversee the case.

With the objection overruled, counsel is now set to move the injunction application, marking the next phase in the legal battle over CJ Torkornoo’s removal.
