Court restrains Peter Amewu from holding himself out as former Hohoe MP

The Court of Appeal sitting in Koforidua has granted an interlocutory injunction restraining John Peter Amewu from presenting himself as a former Member of Parliament for the Hohoe Constituency in the 8th Parliament of Ghana.

The injunction follows an application brought by Professor Margaret Kweku and others from the Santrokofi, Akpafu, Lolobi, and Likpe (SALL) traditional areas.

The Court further restrained the Speaker of Parliament from processing or paying any entitlements to Mr Amewu as a former MP, pending the hearing and determination of the appeal.

This legal development stems from an election petition filed against Mr Amewu’s election. On July 29, 2024, the Ho High Court, presided over by Justice Owoahene Acheampong, dismissed the petition on the grounds that it lacked jurisdiction to hear the case.

Subsequently, a Notice of Appeal was filed on July 31, 2024, challenging the High Court’s decision. The interlocutory injunction application was filed at the Court of Appeal on December 23, 2024.

Arguing the application, lead counsel for the petitioners, Mr Tsatsu Tsikata, urged the Court to halt any recognition or benefits due Mr Amewu as a former MP in the interest of justice, until the appeal is fully heard.

In response, counsel for Mr Amewu contended that his client had done nothing wrong and argued that the Electoral Commission, not Mr Amewu, should be held accountable if there were procedural errors.

Delivering the ruling, the three-member panel chaired by Justice Bright Mensah found merit in the application and granted the injunction. The other panel members were Justice Noble Nkrumah and Justice Hafisata Amaleboba.

The matter remains pending until the substantive appeal is heard.
