Kilmar Abrego Garcia Garcia, 30, is a Salvadoran national who fled gang threats in his native country as a youth and entered the United States illegally.
In 2019, he was protected from deportation to El Salvador by an immigration judge.
But the Trump administration unintentionally deported the union member and sheet metal worker to El Salvador in March 2025.
Following a court order, he was brought back to the United States in June, where he was charged with smuggling human beings, an allegation he rejects.
The government is still trying to deport him, citing nations including Ghana, Uganda, and Eswatini, which his attorneys claim is retaliatory.
