The addendum was void Ab initio

Martin Amidu has challenged the legality of the initial addendum to the TCS contract, insisting it was “void ab initio” and therefore could not have been renegotiated as claimed by Finance Minister Dr. Ato Forson.
He argued that the addendum signed on 4 November 2024 by former GRA Commissioner-General Julie Essiam violated constitutional requirements.
“It was not entered into with the prior authorization of Parliament and was not subsequently laid before the last Parliament,” he said.
Amidu dismissed Dr. Forson’s explanation that the agreement approved by Parliament was merely a correction of the earlier addendum.
“The Minister for Finance was being economical with the truth,” he stated.
According to him, the Constitution rendered the addendum invalid from the outset, making any renegotiation impossible.
“The void addendum… was not binding on the Government of Ghana under the Constitution and could not be renegotiated,” he emphasised.
He accused Dr. Forson of misleading the public by suggesting that parliamentary approval was necessitated by obligations imposed by the earlier agreement.
