Martin Kpebu case not a ‘trap’ or self-investigation’

The Office of the Special Prosecutor (OSP) has addressed claims surrounding the arrest of lawyer Martin Kpebu, stating that the incident was not a “trap” and did not involve self-investigation.

Sammy Darko, Director of the Specialised Reporting and Compliance unit, clarified that all investigators handling Kpebu’s case hold ranks equivalent to Deputy Commissioners of Police, contrary to Kpebu’s claims that only “junior staff” were involved.

“Fact-finding committees exist to establish facts—not to pronounce guilt or innocence. Police misconduct is not investigated by fire service officers; GRA misconduct is not investigated by immigration officers,” Darko said, highlighting proper institutional procedures.

He added that Kpebu’s assertions that the OSP is investigating itself are either a misunderstanding or deliberate misrepresentation.

Darko explained that Kpebu’s confrontational behaviour at OSP premises included moving into restricted areas, ignoring repeated warnings, and verbally abusing security personnel.

“His continued insults and obstructive behaviour led to his arrest for the offence of obstruction of officers in the performance of their duties,” he said.

Addressing public concerns about Kpebu’s detention, Darko said transfers and processing followed protocol.

“At no point was he denied access to counsel or due process. The Office has applied the law strictly within legal and procedural bounds,” he stated.

The Director concluded by emphasizing that Kpebu’s allegations and the investigation into them remain separate. He is expected to report for further investigations, while a different date will be set for continuation of the inquiry into his claims against the Office.
