Adom-Otchere drags OSP to court, seeks to quash asset declaration order

Paul Adom-Otchere, the former Board Chairman of the Ghana Airports Company Limited (GACL), has filed an application for judicial review at the High Court in Accra against the Office of the Special Prosecutor (OSP).
The legal action seeks to quash a directive from the OSP demanding that he declare his property and income.
In his affidavit, Adom-Otchere states that the OSP’s notice, dated August 4, 2025, is “manifestly unlawful” and constitutes an “abuse of power.” He is seeking several reliefs from the court, including:
- A declaration that the OSP’s directive is unlawful and in violation of the Office of the Special Prosecutor Act, 2017 (Act 959).
- An order of certiorari to bring up and quash the directive for violating due process.
- A declaration that threats of “legal consequences,” “confiscation of property,” and “detention” from the OSP amount to unlawful harassment and a violation of his fundamental human rights.
- An order prohibiting the OSP from detaining or curtailing his liberties for refusing the directive.
- General damages and costs.
Adom-Otchere argues that the OSP has no legal mandate to compel him to declare his assets.
He avers, “I am advised by counsel and verily believe same to be true that nowhere in any of the laws governing the performance of the functions of the Special Prosecutor – Act 959 and L. I. 2374, is he mandated to compel the declaration of properties and income by persons he is merely investigating, has not charged before court or has not obtained any orders compelling declaration of properties and income from this Honourable Court.”
