AG drops charges against Kwabena Duffour, others after state recovers funds

The Attorney-General’s Department has formally entered a nolle prosequi to discontinue the high-profile criminal trial involving former Finance Minister Dr. Kwabena Duffour and seven others.

The decision, announced in a press release dated Tuesday, July 22, 2025, marks a significant turn in the legal proceedings tied to Ghana’s financial sector clean-up.

According to the release signed by Deputy Attorney-General Hon. Dr. Justice Srem-Sai, the decision follows the accused persons’ successful fulfillment of a key condition set by the State: the recovery of at least 60% of the alleged financial losses.

“This is a pragmatic step in line with the overarching national interest of recovering State resources,” the Attorney-General’s office explained. “Continuing with the prosecution will not serve any additional public purpose.”

The case, filed as The Republic v. Kwabena Duffour & 7 Others (CR/0248/2020), was part of broader prosecutions following the government’s sweeping reforms in the financial sector that began in 2018. These prosecutions aimed to promote accountability and recover public funds lost through alleged acts of financial misconduct.

The Attorney-General clarified that the withdrawal of the case does not constitute an exoneration of the accused. “This decision does not imply an absence of wrongdoing nor a vindication of any conduct,” the statement said.

While the exercise of nolle prosequi—a formal notice to discontinue legal proceedings—requires no justification under Ghanaian law, the A-G’s office emphasized that the move was being communicated in the interest of transparency and accountability.

The release further reaffirmed the government’s commitment to protecting the public purse and pursuing justice: “The Honourable Attorney-General remains resolute in his commitment to upholding the rule of law, protecting the public purse, and pursuing justice in all matters of national importance.”
