Citizen sues AG over legality of Special Prosecutor’s powers

A citizen, Noah Adamtey, has filed a suit at the Supreme Court challenging the legal basis of the Office of the Special Prosecutor (OSP), according to Deputy Attorney-General Justice Srem-Sai.
In a public update, he confirmed that the case has been registered as Supreme Court suit number J1/3/2026.
“I can confirm that a citizen — @NoahAdamtey — has sued the Attorney-General in Supreme Court suit number J1/3/2026,” Justice Srem-Sai said.
He explained that the suit questions Parliament’s authority to create a prosecutorial body that operates independently of the Attorney-General.
“His grounds: Parliament has no power to set up an office of a prosecutor which is independent and outside the control of the Attorney-General,” he stated.
Mr. Adamtey is asking the Supreme Court to invalidate parts of the Office of the Special Prosecutor Act. “His relief: An order striking down … the provisions of Act 959 that confer autonomous prosecutorial authority on the Office of the Special Prosecutor or insulate it from the Attorney-General’s constitutional control,” Justice Srem-Sai added.
