High Court clears EC to hold Ablekuma North parliamentary rerun

The High Court has given the Electoral Commission (EC) the green light to proceed with a parliamentary election rerun in Ablekuma North, dismissing a legal challenge by New Patriotic Party (NPP) candidate Nana Akua Afriyie.
Justice Ali Baba Abature ruled that halting the EC’s plans would undermine the constitutional mandate of the Commission.
He emphasized that “the balance of convenience lies in allowing the EC to fulfill its obligation to ensure that the people of Ablekuma North are duly represented in Parliament.”
The decision comes ahead of the EC’s scheduled rerun on July 11, 2025, covering 19 polling stations in the constituency where disputes from the December 7, 2024, parliamentary elections remain unresolved.
Nana Akua Afriyie had argued that the rerun violated a High Court ruling issued on January 4, 2025.
That ruling, according to her legal team led by Gary Nimako, directed the EC to collate results from 62 outstanding polling stations and declare a winner based on that data alone.
Her team further pointed to a January 27, 2025, EC press release and parliamentary briefing by Deputy EC Chair Dr. Bossman Asare, which they said confirmed that only three polling station results were pending at the time.
Despite these arguments, the court maintained that completing the electoral process through a rerun was essential for democratic representation.
The judge stated that the EC’s decision aligns with its broader duty to uphold electoral integrity and public confidence in Ghana’s democracy.
