High Court Dismisses Suhum Election Petition, Awards GH¢200,000 For Costs And Damages

The Koforidua High Court has dismissed the parliamentary election petition filed against the Member of Parliament for the Suhum Constituency, Frank Asiedu Bekoe, popularly known as Protozoa, describing the case as unsupported by evidence.
Delivering its ruling on Thursday, November 18, 2025, the court held that the petitioners failed to establish a prima facie case to warrant the reliefs being sought.
“The petitioners have failed to produce credible evidence in support of the allegations contained in the petition,” the court ruled.
The petition, filed by Kwadjo Asante following the 2024 parliamentary elections, challenged the validity of Mr. Asiedu Bekoe’s election. However, the court found that under cross-examination, the petitioners were unable to prove any of the material claims made.
According to the court, “the evidence placed before this court does not disclose any basis upon which the election of the respondent can be annulled.”
On that basis, the court dismissed the petition in its entirety, describing it as lacking merit and evidence.
Following the ruling, counsel for the respondent applied for costs and damages, arguing that the petition had unnecessarily prolonged litigation and imposed financial and emotional strain on the respondent.
While an amount of GH¢500,000 was requested, the court exercised its discretion and awarded GH¢200,000 as costs and damages in favour of Mr. Asiedu Bekoe.
“The award of costs is intended to compensate the respondent for the inconvenience and expense occasioned by this action,” the court stated.
The verdict affirms the mandate of Mr. Asiedu Bekoe as the duly elected Member of Parliament for the Suhum constituency.
