Martin Kpebu outlines legal grounds for petition against OSP boss

Private legal practitioner Martin Kpebu has outlined the legal grounds on which he intends to petition for the removal of Special Prosecutor Kissi Agyebeng, stating that the law provides ample basis for action.

Speaking on the KSM Show, Kpebu referenced Section 15 of the OSP Act, explaining that the grounds include stated misbehaviour, incompetence, breach of the oath of secrecy, and conduct likely to bring the office into contempt or ridicule.

“These are clear statutory categories,” he said. “My petition will rely on some of them, not all.”

He emphasised that his concerns are not limited to corruption allegations. “It is not only corruption. There is incompetence, misbehaviour and issues of integrity,” he clarified.

Kpebu noted that sixteen petitions have already been filed, adding; “Mine becomes the seventeenth unless another citizen goes ahead.”

According to him, the OSP leadership’s statements about security agencies fall squarely under the provision relating to conduct that brings the office into disrepute.

“You cannot misrepresent agencies like NIB and expect no consequences,” he argued.

He also criticised what he described as a reluctance by the OSP leadership to acknowledge mistakes. “If he had apologised two or three days after the interview, the matter would have died. Humility matters in public office,” he remarked.

Kpebu added that he will provide evidence when the appropriate forum is convened;“If the right conditions are met, I’ll tender everything.”
