Nyindam is Still Kpandai MP — Lawyer Gary Nimako-Marfo argues

Lawyer Gary Nimako-Marfo has asserted that Hon. Matthew Nyindam remains the duly elected Member of Parliament for the Kpandai Constituency, citing the National Democratic Congress’(NDC’s) failure to comply with the law governing election petitions.

Speaking on Okay FM, Nimako-Marfo explained that PNDC Law 234 mandates any party dissatisfied with parliamentary election results to file a petition within 21 days after the Electoral Commission officially gazettes the results.

“The NDC did not act within this statutory period, rendering any attempt to challenge the outcome invalid,” he stated.

According to him, once the gazette is published, the law leaves no room for delay. Parties that fail to contest within the stipulated timeframe are deemed to have accepted the results.

“Anyone claiming the existence of a different or alternative gazette to produce it before Parliament for the scrutiny of all Ghanaians,” he challenged.

Responding to suggestions by the programme host that the law might no longer be applicable, Nimako-Marfo insisted that PNDC Law 234 has not been repealed and remains in full force.

He added that the same law has been relied upon in resolving several recent election disputes, particularly those arising after the 2024 general elections, and continues to guide the courts and Parliament in such matters.

Nimako-Marfo concluded that, based on the clear provisions of the law and the NDC’s failure to meet the 21-day deadline, Hon. Matthew Nyindam must still be recognised as the legitimate MP for Kpandai.
